Plaintiffs’ experts were prepared to testify at trial that had the defendants performed an earlier cesarean delivery, the minor plaintiff would have avoided the last 75 to 90 minutes of labor which, according to the scalp sample and umbilical cord gas tests, resulted in a state of severe fetal and neonatal acidosis. Had this been done, the minor plaintiff’s asphyxia and acidosis at birth, as well as both the short and long term sequela resulting from his hypoxic injury would have been significantly reduced, if not entirely avoided.
