$2 Million Settlement For Failure to Recognize Growth Retardation

Crowe & Mulvey successfully negotiated a $2,000,000 settlement that will provide care for a seven-year-old girl with severe brain damage. The girl’s mother, then 19 years old and expecting her first child, saw a certified nurse midwife for prenatal care. During the pregnancy, the midwife ordered an ultrasound to check the baby’s size, position and amniotic fluid. The midwife never obtained the results of the testing, and failed to realize that the full test had not been performed. In fact, the amount of amniotic fluid was abnormally low, and the baby was suffering from severe growth during the latter part of the pregnancy, which caused her brain injury.
